Marriage as a legal concept, and marriage as a religious institution are not the same thing. Anyone who thinks they are, is either misinformed, or is deluding themselves. As a legal concept, marriage has nothing to do with God, love, children, or family. It refers to a contract. Nothing more. To deny a person the right to enter into a legal contract because of his or her sex is discrimination, plain and simple.
People are free to tie whatever religious significance they wish to marriage, but these personal meanings have nothing to do with the law. There is nothing in the current marriage laws referencing God nor any specific religion.
Unless Roe v. Wade were overturned it cannot be, as the Supreme Court handled this matter long ago. Here's a brief outline of the decision:
Laws limiting or prohibiting abortions in practically all the States, the District of Columbia, and the territories were invalidated by a ruling recognizing a right of personal privacy protected by the due process clause that included a qualified right of a woman to determine whether or not to bear a child. On the basis of its analysis of the competing individual rights and state interests, the Court in Roe v. Wade 201 discerned a three-stage balancing of rights and interests extending over the full nine-month term of pregnancy.
''(a) For the stage prior to approximately the end of the first trimester, the abortion decision and its effectuation must be left to the medical judgment of the pregnant woman's attending physician.
''(b) For the stage subsequent to approximately the end of the first trimester, the State, in promoting its interest in the health of the mother, may, if it chooses, regulate the abortion procedure in ways that are reasonably related to maternal health.
''(c) For the stage subsequent to viability, the State in promoting its interest in the potentiality of human life may, if it chooses, regulate, and even proscribe, abortion except where it is necessary, in appropriate medical judgment, for the preservation of the life or health of the mother.''
Now, since that ruling applies to ALL states pretty much the only things they can regulate are informed consent, parental consent, parental notice, and viability. Anything else is, by definition, unconsitutional.
However, if Roe v. Wade WERE to be overturned the matter would be passed down to the states. And if you wish to define it purely as a medical procedure then the states, according to their own constitutions, can probably regulate it. That's why we have licensing agencies and departments of health. My wife is a nurse, and simply getting the licenses in place is a TEDIOUS procedure. Not to mention random spot checks that ensure everything is being run in compliance with the laws.
But, if you need something that grants federal authority in this matter you need look no further than the elastic clause, Article 1, section 8, clause 18. That's the basis for 90% of the laws we have on the books now. But since medicine is handled on a state by state basis the most common argument I've heard is for abortion regulation to be left up to the state. And that's simply the tenth amendment.
What a waste of 1.75 billion. I mean…we spend that much a week on the war. Instead of helping Americans take sick time or allowing sick children to be with their parents. That's just awful. We could be bombing people with this money! Man…and the end of small business…the sky really will fall…I mean…GRANTS! What a waste! Taking GRANT money and giving it to businesses to pay for leave. Certainly they will all go under once given grant money to pay for this. How ridiculous. Know what sounds better? Starting a war that costs 2 billion a week and then NOT raising ANY taxes to pay for it! That is a much better way to (not tax) and spend!
