However, there are certain causes that are observed more than others: like operating on the wrong part or organ, inability to make a proper incision, leaving surgical instruments inside of the body, inordinate delay in surgery, inordinate prolongation of the surgery, incorrect medication, and many others as the case may suggest.
At times the decision to carry out a surgery itself could be a mistake and lead to medical malpractice. Hospitals are required to carry out an emergency surgery, an urgent surgery and an elective surgery according to specific conditions. Failure to diagnose the right surgery for certain conditions and circumstances amounts to medical negligence too.

Spinal surgery is so uncertain anyway! I have bulging discs in my lower back and did some epidurals with no relief. I was suggested surgery but held off. Several years later I am doing better with just exercise and a good airbed. I also limit my activities that would agervate my problem. i can get a lot of pain and numbness in my legs. I've been told surgery will help some people, some not at all, some make it worse. I have a friend who injured his neck severely at work 15 years ago and five surgery's later he is still no better off! Doctors will tell you a lot of things but go to a spine specialist (like the Cleveland Clinic of Ohio) before you have more surgery done! Some of the non surgical treatment or rehabilitation might do you as good or better!

First of all I am very very sorry to hear that you have this severe infection. Indiana has very stringent medical malpractice laws. They require that the plantiff show a burden of proof about the malpractice. I do not know of any malpractice attorneys but I recommend that you make sure you are being followed by an infectious diseases physician. I wish you healing and all the best.
It was a simple error that did not harm you in anyway. You suffer no long term permanent damage from this….why would you want to sue. Not everyone is perfect that is why they did the second test (blood test) to confirm before surgery.

Bottom line – You were not injured by any negligence. No injury – no med mal case. Even if you consider the 3d incision an injury, it's not worth anything and no med mal attorney would even consider taking such a case.

I'm only a legal secretary, but I would say you definitely have enough for a lawsuit. I don't know what state you are in, but you need to contact a med mal attorney in your area. If you don't know of any, you can contact your local bar association and they will give you a list of attorneys that handle med mal cases. You can search"<your state> bar association" on google and it should pull up their website. If the attorney doesn't think you have a case then you haven't lost anything but a few minutes of your time. It's worth a try, that's for sure. It's possible you only have a year to file a claim though, so make sure you check it out soon. Good luck!
